I purchased a $1600 dining room set on Sat. They only had 4 of the 6 chairs so we opted to pay $100 for delivery on Mon. or Tues. according to merchant. we decided that day that we changed our minds... so Sunday we called him back to say cancel our order. he said he already had it "on the truck ready for delivery Monday. Otherwise we would have to pay 25% re-stocking fee or take a store credit. He called us Tues. to say it would be here Wed. which changed to Thursday and today we received yet another call saying due to weather (grey skies!) he wouldn't be able to deliver it til' Fri! we called Bof a where they are refunding the $$ tonight. we let the merchant know and he said he will be suing us blah blah blah. I want to know if there is anyway that we will be liable for any fees (re-stocking fee etc.) in this situation. Am I protected? is he in the wrong or am I? PLEASE only people who know for sure give me your input and firsthand knowledge:)
